1 Agreement to Terms

These Terms of Use ("Terms") govern access to and use of the RN Navigator website and web application operated by RN Navigator App, LLC ("RN Navigator," "we," "us," or "our"). Registration requires separate acceptance of these Terms and confirmation that you are at least 18. Our Privacy Policy explains how we handle personal information. Our Customer Services Agreement (Checkout Terms) applies to subscription purchases and is accepted immediately before Checkout, together with a separate recurring-billing authorization. Registration or public informational browsing does not authorize a charge or constitute purchase of a subscription. If you do not agree to the terms applicable to an account or purchase, do not register or purchase.

2 Nature of Service and Independent Status

RN Navigator provides educational information, decision-support resources, and exploratory pathway tools concerning nursing education and career development. RN Navigator is an independent information service and is not a nursing school, educational institution, accrediting body, state licensing board, healthcare provider, employer, recruiter, or financial-aid authority. RN Navigator is not affiliated with, sponsored by, or endorsed by the National Council of State Boards of Nursing (NCSBN), any state board of nursing, or any academic accreditation agency.

3 Educational Information No Guarantees

All educational pathways, admissions requirements, tuition figures, licensure standards, NCLEX data, and accreditation statuses are compiled for general informational purposes only and are subject to change without notice.

RN NAVIGATOR DOES NOT GUARANTEE:

  • Acceptance into any academic program or school;
  • Passage of the NCLEX or any professional, certification, or licensing exam;
  • Receipt of clinical placements, transfer credits, academic degrees, or professional licensure; or
  • Employment, specific salary levels, or career advancement.

Users must independently verify all critical academic, tuition, and professional information directly with the applicable school, licensing board, or regulatory agency prior to taking action.

4 No Professional Advice or Clinical Counseling

The materials, content, and tools available through RN Navigator do not constitute medical, clinical nursing, patient care, legal, tax, financial, formal academic, or individualized licensure counseling. Content on RN Navigator is strictly for consumer career exploration and educational decision support, and must never be used for clinical diagnostic, therapeutic, or direct patient care decisions.

5 Account Registration Eligibility and Security

  • Age Requirement (18+): You must be at least eighteen (18) years of age and possess the legal capacity to form a binding contract to register or use RN Navigator. References to high school or early preparatory pathways are informational only and do not authorize account creation by minors.

Registration Acceptance: The 18+ confirmation and Terms acceptance are separate and initially unchecked. Age confirmation does not constitute contractual acceptance. We retain separate records of these acknowledgements as described in the Privacy Policy.

Arbitration Notice: Section 14 provides a 30-calendar-day opt-out from mandatory arbitration, the class action waiver and the jury trial waiver. Day 1 is the day after both account creation and express Terms acceptance are complete. Send your notice by 11:59 p.m. Eastern Time (America/New_York) on day 30 to support@RNNavigatorApp.com with your legal name, account email and an express statement opting out. A notice sent by that deadline is timely; reasonable evidence of sending establishes timeliness if delivery is disputed. Email verification, Checkout, resending a confirmation email and account recovery do not restart the period or override a valid opt-out.

  • Minor Account Discovery & Enforcement: If RN Navigator reasonably determines or receives notice that an account is maintained by an individual under age 18, it will immediately suspend or terminate the account, delete associated personal data consistent with applicable law, and issue a prorated refund of any unearned subscription fees.
  • Account Security: You are solely responsible for maintaining credential confidentiality and for all activities conducted under your account.

6 Subscription Terms Automatic Renewal and Billing

  • Continuous Monthly Subscription: Access is provided via an automatically renewing monthly subscription priced at $1.99 USD per month (plus applicable sales tax).
  • Automatic Renewal Authorization: BY PURCHASING A SUBSCRIPTION, YOU EXPRESSLY AUTHORIZE RN NAVIGATOR TO CHARGE YOUR STORED PAYMENT METHOD $1.99 PLUS APPLICABLE TAXES EACH MONTH UNTIL YOU CANCEL. YOUR PAYMENT OBLIGATIONS ARE SUBJECT TO THE CANCELLATION AND REFUND EXCEPTIONS BELOW.
  • Payment Processing: Recurring charges are processed through Stripe on the monthly anniversary of your purchase. We do not store complete payment card credentials. There is no free trial.
  • Cancellation: You may cancel at any time without fee or penalty through Account > Manage Billing or by emailing support@RNNavigatorApp.com. We aim to process email cancellation requests within 48 hours and will process them no later than 72 elapsed hours, including weekends and holidays. A request that clearly asks to stop renewal and reasonably identifies your subscription is honored from receipt by our support email system, not from the time we process it. If it arrives before renewal but processing occurs after a renewal charge, we will refund that charge, including collected taxes. Access continues through the period paid for before cancellation took effect, not through a mistakenly renewed period. We will acknowledge your request and confirm completion and the paid-through date. If clarification is necessary, we will promptly ask and preserve the original receipt time for review. This processing maximum does not extend your cancellation deadline.
  • Refund Policy: Subscription payments are generally nonrefundable and non-prorated except as required by law, for a prorated refund of any unearned subscription fees under the minor-account provision in Section 5 of the Terms of Use, and for renewal charges including collected taxes following a timely cancellation request. We do not duplicate amounts already returned. Contact support@RNNavigatorApp.com for refund requests.
  • Price Changes: The subscription price is $1.99 per month plus applicable sales tax. Any future increase requires separate review before implementation. Active subscribers will receive at least 30 days advance written email notice and clear cancellation instructions before any increase, together with any consent required by applicable law.

7 Intellectual Property and Limited License

All software, visual interfaces, compilation designs, databases, algorithms, graphics, domain names, and original content created by RN Navigator App, LLC remain our exclusive intellectual property. Subject to compliance with these Terms, RN Navigator grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the platform for individual, non-commercial educational purposes only. All rights not expressly granted are reserved.

8 Third Party Sources and Links

RN Navigator may reference or link to external nursing schools, regulatory boards, or third-party web resources. Such references do not constitute an endorsement, affiliation, or sponsorship. We are not responsible for the accuracy, availability, or privacy practices of third-party entities, and you access external sites entirely at your own risk.

9 Acceptable Use and Security Restrictions

You agree not to use RN Navigator unlawfully or in violation of these Terms. You shall not:

  1. Attempt unauthorized access to accounts, systems, administrative networks, or source code;
  2. Introduce viruses, malware, or harmful code;
  3. Scrape, crawl, harvest, mirror, or systematically extract data or content at scale without prior written consent;
  4. Use any platform content, user data, or pathway compilations to train, tune, or feed artificial intelligence (AI), machine learning (ML), or automated data models; or
  5. Reverse engineer or decompile any software, except as permitted by applicable law.

10 Service Modifications and Uptime

We reserve the right to modify, update, temporarily suspend, or discontinue any feature of RN Navigator at any time without liability. We do not warrant uninterrupted, error-free, or continuous service availability, and we are not liable for service interruptions, technical errors, or scheduled system maintenance.

11 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RN NAVIGATOR AND ALL RELATED TOOLS, CALCULATORS, AND CONTENT ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. RN NAVIGATOR APP, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, TIMELINESS, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES REGARDING THE COMPLETENESS, ACCURACY, OR RELIABILITY OF ANY TUITION, ADMISSIONS, NCLEX, LICENSURE, OR ACCREDITATION DATA. STATUTORY CONSUMER RIGHTS MANDATED BY LAW REMAIN UNAFFECTED.

12 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RN NAVIGATOR APP, LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES - INCLUDING LOSS OF PROFITS, DATA LOSS, TUITION EXPENSES, APPLICATION FEES, OR COSTS OF SUBSTITUTE SERVICES - ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO RN NAVIGATOR DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) FIFTY UNITED STATES DOLLARS ($50.00 USD). THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY RESULTING FROM RN NAVIGATOR’S GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR MATTERS WHERE LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

13 User Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless RN Navigator App, LLC, its members, officers, and employees from any third-party claims, liabilities, or expenses (including reasonable attorneys' fees) arising out of your willful misconduct, unlawful acts, violation of third-party rights, or material breach of these Terms. This obligation does not apply to routine, intended consumer use of the service.

14 Dispute Resolution Binding Arbitration and Forum Selection

  • Governing Law & Forum: These Terms and all disputes arising from them are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Permitted judicial proceedings must be brought exclusively in state courts in Houston County, Georgia (or the U.S. District Court for the Middle District of Georgia).
  • Mandatory Informal Resolution: Prior to initiating arbitration or legal proceedings, both parties agree to attempt good-faith informal resolution for thirty (30) days by submitting written notice to support@RNNavigatorApp.com.
  • Binding Individual Arbitration: Unresolved claims shall be settled by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The Federal Arbitration Act ("FAA") governs enforcement.
  • Small-Claims Exception: Either party may bring an individual claim in Houston County Magistrate Court (or resident small-claims court of competent jurisdiction) for qualifying claims within applicable jurisdictional dollar limits.
  • CLASS ACTION AND JURY TRIAL WAIVER: ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS. NEITHER PARTY MAY JOIN OR CONSOLIDATE CLAIMS AS A CLASS REPRESENTATIVE OR CLASS MEMBER. BOTH PARTIES WAIVE ALL RIGHTS TO A TRIAL BY JURY.
  • 30-Day Opt-Out: You may opt out of mandatory arbitration, the class action waiver, and the jury trial waiver by emailing support@RNNavigatorApp.com with your legal name, account email, and an express statement opting out. The thirty (30) calendar-day opt-out period starts on the day after both account creation and your express acceptance of these Terms are complete, and ends at 11:59 p.m. Eastern Time (America/New_York) on day 30. An opt-out notice sent by that deadline is timely. If delivery is disputed, reasonable evidence that the notice was sent by the deadline will establish timeliness. A timely opt-out removes mandatory arbitration, the class action waiver, and the jury trial waiver together.
  • Arbitration Severability: If any portion of this Section is found unenforceable, it will be severed; provided, however, that if the Class Action Waiver is invalidated, Section 14's arbitration mandate becomes null and void, and claims shall proceed in the courts identified herein.

15 General Terms

  • Severability: If any provision is deemed unlawful or unenforceable, that provision shall be modified to the minimum extent necessary, leaving remaining provisions fully enforceable.
  • Force Majeure: We are not liable for service delays or failures caused by events outside our reasonable control.
  • Entire Agreement: These Terms and, for a subscription purchase, the Customer Services Agreement govern your use of the applicable services. Our Privacy Policy describes our information practices. Registration alone does not accept the Customer Services Agreement or authorize recurring charges.

If you believe any content on RN Navigator infringes your copyright, please submit a written notice to our copyright contact at support@RNNavigatorApp.com pursuant to 17 U.S.C. § 512(c)(3) containing your contact details, identification of the copyrighted work, and a statement made under penalty of perjury that you are the copyright owner or authorized agent.

17 User Feedback License

Any feedback, comments, suggestions, or feature requests submitted by you regarding RN Navigator shall become the sole property of RN Navigator App, LLC. You grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use, incorporate, and commercialize such feedback without restriction or obligation.
